term of this Licence on four weeks’ notice to the Licensee (or such shorter period
as the University considers reasonable in the circumstances).
3.4.
By way of non-exhaustive examples only, and without any limitation, the Universitymay
exercise the right reserved in clause 3.3.2 of the this Licence in circumstances where in the
reasonable opinion of the University the Room and/or Common Areas are not fit for
purpose, or it is appropriate in order to protect the interests of staff and/or other
residents, or the Room is reasonably required by the University to discharge a duty tomake
reasonable adjustments in accordance with the Equality Act 2010 as amended or replaced or
in such circumstances (other than circumstances relating to discipline which are provided for
below at clause 3.5) as the Universitymay reasonably deem appropriate.
3.5.
Without prejudice to clause 3.10, and for the avoidance of any doubt, the University has
the absolute right to move the Licensee to another Room and/or Halls of Residence in the
event that disciplinary proceedings (including investigations) are commenced against the
Licensee under the Residential Disciplinary Procedure, the University’s Regulations on
Student Discipline and/or where criminal proceedings (including investigations) are
commenced.
3.6.
In exceptional circumstances and subject to the charges set out in this Licence, a Licensee
may, with the University’s consent, change Rooms or Halls of Residence during the
Residential Year. The University will consider requests on their merits, in the light of the
availability of alternative Rooms and the practical and financial implications for the
University of granting such consent and in such circumstances clause 4.3.3 shall apply.
3.7.
While the Licensee occupies the Room as a single, private study room, he/she is permitted
to have one overnight guest in the Room for nomore than two consecutive nights in any one
week, provided that the Licensee:
3.7.1.
signs his/her guests in at the relevant reception, does not give his/her keys/swipe
cards (and/or copies) to any guest and takes reasonable steps to ensure that
his/her guests are not left unattended at all reasonable times while in the Halls of
Residence;
3.7.2.
ensures that such guests comply with the fire safety procedures for the relevant
Halls of Residence;
3.7.3.
does not intend to accommodate a guest who has been banned from the University
campus;
3.7.4.
has obtained the agreement of flat mates in a single sex denominated flat, where
the guest may be of the opposite sex; and
3.7.5.
has not been issued with a ban from bringing guests into the flat in accordance
with the Residential Disciplinary Procedures.
3.8.
The Licensee is entitled to use the Room during the Christmas and Easter vacations.
3.9.
The University reserves the right:
3.9.1.
for authorised personnel to enter the Room on reasonable notice to inspect its
condition, to clean the Room on a regular basis (if applicable), to carry out such
repair works as the University thinks necessary, to respond to a maintenance
request, to investigate a potential emergency or health and safety concern, or to
serve a notice to vacate the Room in accordance with the University’s rights under
this Licence and for other appropriate purposes which in the reasonable opinion of
the University require entry to the Room;
3.9.2.
to prohibit visitors at any time if necessary in the interests of security and/or the
health and safety of other residents and/or staff and for such other purposes as the
University reasonably decides requires the prohibition of visitors; and
3.9.3.
to request the Licensee tomake the Room and associated Common Areas available
as a Show Flat. The Licensee may refuse this request. In the event that the
Licensee accepts that University’s request pursuant to this clause 3.9.3, the
